Rule 135 (1) of The Patents (Amendment) Rules, 2016

(1) The authorization of an agent for the purposes of the Act and these rules shall be in Form 26 or in the form of a power of attorney.

Present:

(1) The authorization of an agent for the purposes of the Act and these rules shall be in Form 26 or in the form of a power of attorney within a period of three months from the date of filing of such application or document, failing which no action shall be taken on such application or documents for further processing till such deficiency is removed.

General Understanding:

Sub-rule (1) of rule 135 says that the authorization of an agent shall be made within three months from the date of filing of such application or document and if failed to file it then no action lies for further processing till the removal of such deficiency.

Amendments:

For the first time amended in 2016.

Advantage:

Earlier, there was no prescribed time. But, now authorization has to be filed within three months.
