Rule 133 of The Patents (Amendment) Rules, 2016

Earlier:

  1. Supply of certified copies and certificates under sections 72 and 147

Certified copies of any entry in the register, or certificates of, or extracts from patents, specifications and other public documents in the patent office, or from registers and other records including records in computer floppies, diskettes or any other electronic form kept there, may be furnished by the Controller on a request there for made to him and on payment of the fee specified there for in the First Schedule.

Present:

  1. Supply of certified copies and certificates under sections 72 and 147

(1) Certified copies of any entry in the register, or certificates of, or extracts from patents, specifications and other public documents in the patent office, or from registers and other records including records in computer floppies, diskettes or any other electronic form kept there, may be furnished by the Controller on a request there for made to him and on payment of the fee specified there for in the First Schedule:

Provided that certified copies shall be issued in the order in which the request is filed.

(2) Notwithstanding anything contained in sub-rule (1), certified copies shall be furnished within a period of one week if such request is made along with the fee specified therefore in the First Schedule.

General Understanding:

Earlier rule 133 has no sub-rules but after the 2016 amendment, it has got two sub-rules which together say that the Controller may furnish any certified copies or certificates or any documents respectively on a request made to him and on the payment of fee. But if such request is made along with payment of fee specified then the certified copies has to be furnished within one week.

Amendments:

No amendment before 2016.

Advantages

The wait period for obtaining Certified Copies will be Comparatively lesser than earlier.
